Employment and Fair Work Issues Clinic

For 2022, the Australian Childcare Alliance (ACA) NSW has updated and expanded its Quickies series of short but to the point presentations that help existing and new providers.

The ACA NSW Quickies are only 2 hours or less and held throughout the year in face-to-face, live webinar and video-on-demand formats. They are for Approved Providers, Owners, Directors and Nominated Supervisors with industry-specific information, advice, tips and even “tricks”.

The ACA NSW Quickies – Employment and Fair Work Issues Clinic has been designed as an Open Forum - giving all attendees an opportunity to ask questions, discuss specific examples, obtain advice, and engage in understanding an employers' rights, obligations and expectations under current Fair Work requirements and Industrial Laws.  It is a unique opportunity to obtain specific guidance and legal advice for your particular service and circumstances. 

The kind of questions that will be posed are: 

  • Can pay rates agreed in employment contracts supersede Award classifications and pay rates?
  • Can employers and/or employees have shorter notice periods?
  • Is it legal to have different leave entitlements than maternity leave; personal leave; compassionate leave?
  • Is it possible to terminate employees without a performance management process?
  • What rights and levers do employers have to get employees to work, especially during COVID?
  • Will the Fair Work Ombudsman only facilitate only genuine unfair dismissal claims?

This clinic session is designed for Approved Providers and those responsible for managing a team of staff to raise questions and discuss issues based on their shared experiences of managing staff in Early Education and Care Services. The clinic aims to equip attendees with a toolkit of answers to staffing and employment issues to enable them to confidently deal with their staff and comply with their legal requirements and avoid Fair Work proceedings.

Ticket Prices (not including EventBrite fees):

  • ACA NSW Members: $50 inc GST per person
  • Non-Members: $85 inc GST per person (or $75 inc GST per person for early birds up to 8 weeks prior)

Your Presenters:

Belinda Kenneally is the principal solicitor of Kenneally & Co Lawyers. Her legal practice extends over twenty years with particular experiences with the early childhood education and care sector. She is one of the primary legal counsels to the Australian Childcare Alliance NSW and its members on matters including workplace and commercial disputes and advice, serious incidents, commercial leases, defamation, handling family access issues as well as regulatory disputes.

Chiang Lim is the CEO of the Australian Childcare Alliance NSW. He brings over 20 years of professional industry advocacy, organisational and business administrator, political agitator, entrepreneur and solutions seeking. His experiences include not-for-profit industry associations, information technology, telecommunications, defence, national and international standards development, human rights, fast-moving consumer goods (FMCG), local governments, and early childhood education and care.
