Effective DA Disputes with Councils 2023

Owners and Approved Providers of early childhood education and care services can often find themselves in the midst of disputes with local councils that result from different views of legal requirements as well as their management of expectations of their local constituents.

Therefore, finding and navigating paths toward resolution is often the skill of minimising both time and costs.

The 2023 ACA NSW Quickies – Effective DA Disputes with Councils will cover the following topics, information, advice, tips and even “tricks”:

  • Are the “non-compliances” based on existing statutory requirements?
  • Can disputes with the local council/community be anticipated?
  • How can your DA follow the optimum pathway towards approval?
  • What is/are the alternative legal pathway(s) to resolution with the local council?
  • Understanding the applicable controls
  • What can the NSW Land & Environment Court do/not do?
  • Considerations when negotiating long-term leases, including risk mitigation
  • Greenfield sites - managing delivery risk.
  • Rent calculations, permitted use and funding.
  • Due diligence on established sites

This ACA NSW Quickies session is designed for the service’s owners and Approved Providers.
